Sometimes in business there are delays in payments and a temporary loss of financial liquidity, and then it may happen that your bank account is seized by a bailiff. Such a seizure is problematic, especially when you have to pay the salaries of your employees and contractors.
If your bank account has been seized by a bailiff, remember that in accordance with Article 890 § 2 of the Code of Civil Procedure, receivables on a bank account seized by a bailiff do not apply to payments from that account of current wages for work together with taxes and other statutory charges up to the amount of the average wage from the previous quarter announced by the President of the Central Statistical Office in the Official Journal of the Republic of Poland, "Monitor Polski".
This means that despite the seizure, you can still pay the wages of your employees and contractors.
To do this, you must obtain the bailiff's permission, because in accordance with Article 890 § 21 of the Code of Civil Procedure, the bank makes payments based on the bailiff's permission.
To do this, you should:
1) submit an appropriate application,
2) submit to the bailiff a copy of the payroll or other credible document showing the amounts due to your employees.
Article 890 § 2 of the Code of Civil Procedure states that the exemption from enforcement applies to current payments for remuneration for work and covers the entire remuneration, including awards, bonuses, etc. resulting from the employment contract, but also from the contract of mandate.
