Legal Counsel Sylwia Hamryszak
- She successfully filed a number of applications for consumer bankruptcy, where the total debt of individual natural persons ranged from several dozen thousand to even several million zlotys.
- She advised entrepreneurs, including commercial law companies on the verge of bankruptcy, so as not to expose entrepreneurs to the risk of dismissal of a bankruptcy application due to lack of funds to cover the costs of bankruptcy proceedings. She successfully appealed against applications dismissing bankruptcy, demonstrating the debtor's bankruptcy capacity.
- She advised on obtaining financing for a company in the deep restructuring phase based on the Act of 16 July 2020 on granting public aid to rescue or restructure entrepreneurs - leading to the granting of a loan from Agencja Rozwoju Przemysłu SA for the amount of over PLN 1.3 million. She provided ongoing advice to a number of companies in restructuring, including those in the pharmaceutical, energy and transport sectors. She appeared in court proceedings, leading to the winning of court disputes based solely on the allegation of the defendant's lack of passive legal standing (incorrectly suing the debtor instead of the Administrator of the restructuring estate or the bankruptcy trustee).
- In cooperation with a restructuring advisor and the debtor himself, she led to the conclusion of an arrangement with creditors in the bankruptcy arrangement proceedings concerning a company from the development industry, under which the creditors obtained 100% satisfaction of the principal claims. She advised on the construction of arrangement proposals in a number of restructuring proceedings, so that the interests of creditors were protected to the highest degree, while maintaining the debtor's payment capacity. She provided legal advice thanks to which it was possible to protect the debtors' funds from single enforcement and selective satisfaction of creditors at the pre-bankruptcy stage, when debtors were deprived of anti-enforcement protection due to the applicable legal regulations.

- In March 2023, it filed bankruptcy applications for a group of 3 companies with the National Register of Indebted Persons. The total amount of receivables included in the applications exceeded PLN 100 million, and the number of creditors exceeded 2,000. The office had a short deadline to prepare the documentation and submit the applications themselves, because the statutory deadline for filing bankruptcy applications expired soon. The timely submission of applications allowed for protecting the Presidents of the Management Boards from liability for the obligations of the Companies.
- In December 2023, in cooperation with a company from the telecommunications industry, it processed the submission of a collective list for the purpose of paying employees' salaries from the Guaranteed Employee Benefits Fund. The submission of the list allowed for the payment of arrears of salaries to employees
- She conducted effective negotiations with the Tax Offices and the Social Insurance Institution, as a result of which the company in a difficult financial situation concluded installment arrangements. Negotiating the agreements protected the company from the threat of bankruptcy. The value of liabilities divided into installments amounted to over PLN 10 million.
- She represented the Debtor in the proceedings aimed at annulling the decision to discontinue the restructuring proceedings. The Debtor and the Creditors were in the process of developing arrangement proposals, however, at the request of the administrator of the restructuring estate, the Court discontinued the restructuring proceedings, which blocked the possibility of concluding the arrangement. Thanks to the effective appeal and the arguments contained in the arguments, which were fully shared by the Court of Appeal, the decision was annulled, and the Debtor and the Creditors were given the opportunity to conclude an arrangement that was satisfactory to them.

- Based on the instruments provided for in the Bankruptcy Law, and further in the Civil Code (Pauliana action), they have validly declared ineffective legal actions of debtors leading to their insolvency or deepening this state, thus protecting creditors from harm. The total value of assets recovered for the benefit of creditors amounts to several million złoty.
- They successfully conducted the group layoff procedure in a large mining and transport company. Thanks to the efficient negotiation with employees, it was possible to quickly reach an agreement and carry out group layoffs.
